    Recent Immigration Practices in Finland

    Towards the end of the year, foreign researchers are busy renewing their residence and working permits. Some foreign researchers (including those coming from outside EU) have to renew their residence permits annually. This article relates certain unfortunate experiences that people have gone through due to the recent Finnish Immigration Police practices.

    Finnish Immigration Police Department has implemented an appointments system for immigration related matters. Everyone has to make an individual appointment to submit his or her application. The duration of each appointment is approximately 30 minutes.

    In fact, these appointments are not always at the end of the year. As we are well aware, not all, but many researchers (foreign researchers as well) do not get their contracts renewed until December due to the varying finance situations in different departments and units. What is more, they are only able to make their appointments after the renewal of the contract.

    The problem is that the Immigration Police is dealing with hundreds of applications coming from the whole municipality monthly. As a result, the queue for appointments is extremely long, stretching up to two months just for the submitting of the application for the renewal of the residence permit. At the moment, the earliest time slots available for foreign researchers for submitting their form are in the beginning of the next year, in the worst case next February, instead of the end of the present year. This has resulted in considerable difficulties.

    If the renewal is as late as February, the residence permit of these immigrants will have expired and it has become illegal to reside in Finland. This is a huge problem for researchers coming from outside EU. Finnish authorities may deport many of them to their home countries because they no longer have a legal document that would justify their staying in Finland.

    Those from the nations whose citizen must have a visa to enter Finland are worried most. This is not a pleasant experience to go through.

    To add more salt to the wound, after the residence permit has expired, University of Helsinki, for example, will not allow foreign researchers to work in their premises or receive salary before their permits have been renewed. Their salary will be paid starting from the date they have submitted their application. Non- EU researchers suddenly have no income until the date they have submitted their application, although they have already had their contracts renewed.

    Many non-EU researchers have little knowledge about Finnish working acts. They do not know where to find the relevant information, or where to find legal advice. Suddenly, they find themselves in a very difficult situation because of this new appointments system of the Immigration Police.

    After the forms were stamped on the day they were received by the Police, the residence permit renewing process was considered to be on even though the forms were sent back to the related Immigration Police Department for processing. Therefore, some of those staying in Helsinki traveled to the Immigration Police Departments of other municipalities, i.e. Lahti, with their family members, just to submit their application forms earlier in order to maintain their legal working status in Finland.

    Some of them were trying their luck by following the website with Police appointment time slots, with the hope that someone might give up his or her appointment and they could reserve an earlier appointment to submit their application. Some went to queue in front of the Immigration Police Department early in the morning. Of course, the Police refused to accept their forms and insisted that an appointment should be made. Do non-EU researchers deserve such treatment?

    Perhaps the Police had at some point learned that certain legal difficulties occurred to foreigners coming from outside EU because of the extreme long appointment queue. As a solution, they made a decision that “all applications are considered submitted when the booking for an appointment is made”.

    However, no information concerning this change can be found on the English-language website of the Immigration Police. This piece of information was distributed by some non-EU researchers who went to queue in front of Helsinki Immigration Police Department early in the morning. They double checked the information with the International Human Resources Coordinator of University of Helsinki, and received confirmation that University of Helsinki has acknowledged this decision by the Immigration Police. This decision solved many legal problems which non-EU researchers had been dealing with.

    International Human Resources Center of The University of Helsinki has been communicating with Finnish Immigration Police Department diplomatically to find a better solution to these difficulties that the University's foreign staff have to face. Whether they will arrive at a reasonable outcome remains to be seen. The appointments system remains. Will it be improved so that it can serve the interests of foreign employees better? Let’s have our fingers crossed.

    Can the working life of those coming from outside EU be that difficult in Finland? The first requirement for non-EU foreigners in order to continue to work in Finland is to have a valid residence permit from the Finnish Immigration Police. However, the impression we often get is that as foreigners coming from outside EU, we are not very welcome.

    The comment on the text by the Immigration Affairs -section of the Licence Administration Unit of the Helsinki Police Department:

    "If they so wish, the customers have the chance to come to the foreign affairs customer service also without appointment. The customers have to first register in the info queue. It is advisable to arrive to the Department already in the morning. The waiting customers will be served in the order of arrrival. The waiting period may last for several hours and the customers will be called to the customer service desks separately by name. It is important to have the residence permit application filled beforehand. In the Helsinki Police Department, the applications waiting for processing are deemed to be initiated on the date when the appointment was made — presuming that the customer turns up at the exact time reserved for him/her or reports of an obstacle before it."


    Hervannan henki

    Tampereen teknillisen yliopiston johdon seminaarissa oli syksyllä 2013 keskusteluteema Hervannan henki. Melko yksimielisesti oltiin sitä mieltä, että Hervannan henki haisee ja termin käytöstä pitää luopua. Uutta positiviista termiä ei ole taidettu löytää tilalle.

    TTY:n lukuisat YT-neuvottelut ovat varmasti yksi syy huonoon henkeen ja toinen on varmasti TTY:n sisäinen tulospistejärjestelmä, joka ei arvosta opetustyötä ja joka panee opettajat kilpailemaan keskenään. Osa henkilöistä on perättäin kaksisssa YT-neuvotteluissa, ensin laitoksen ja sitten henkilöstöryhmän, esim. laboratoriohenkilöstön. Tuntuu, ettei TTY pysty ja halua tehdä organisaatiomuutoksia ilman YT-neuvottelujen uhkausmentaliteettia.

    Tulospisteet tulevat pääosin opiskelijoiden suorituksista, väitöskirjoista ja diplomitöistä. Uutena elementtinä ovat julkaisut, jotka tietysti mittaavat tutkijan aktiivisuutta. Jos opettaja käyttää esim. puolet työajastaan opetukseen, se on tulospistemielessä lähes arvotonta työtä. Kuitenkin opetuksen tulisi olla yliopistojen ydintyötä. Millainen on organisaatio, joka ei noteeraa juuri lainkaan ydintyötään?

    TTY:n hallintojohtaja Tiina Äijälä kertoo Acatiimissa 6/2014, että TTY:n laitos on itsenäinen talousyksikkö, jonka tulee pärjätä saamallaan valtionavulla ja hankkimallaan täydentävällä rahoituksella. Tämä kuulostaisi täysin perustellulta, jos laitokset rahoittaisiin täysimääräisesti.

    Olin vuodet 2010—2013 laitosjohtajana. Kolmena ensimmäisenä vuotena saimme riittävän rahoituksen ja ylijäämänne oli kaikkina näinä vuosina yli 100 000 euroa. Vuonna 2013 laitokseemme siirtyi nettomääräisesti kaksi professoria ja muuta henkilöstöä ja uusia laboratorio- ja huonetiloja. Saimme näistä siirroista lisärahoitusta noin 250 000 euroa, mutta em. siirtojen kustannusvaikutus oli noin 500 000 euroa. Meidät oli alibudjetoitu eikä meillä ollut vuoden 2013 aikana mitään mahdollisuutta pysyä annetussa budjetissa.

    TTY:n laitosten rahoitus ei ole avointa ns. laitosten tulosrahaa lukuunottamatta. Tämän osuus oli laitoksellamme TTY:n rahoituksesta vain noin 10 prosenttia vuonna 2013. TTY:n johto pystyy saamaan laitokset alijäämäisiksi alibudjetoinnilla. Toisaalta vielä 2010-luvulla on kuitenkin ollut tilanteita, että laitoksille on kertynyt yliopiston johdon hyväksynnällä 500 000—1 000 000 euroa alijäämä. Laitosten alijäämiin on puututtu hyvin erilailla ja erilaisella nopeudella epätasapuolisesti.

    Tiina Äijälä kertoo, että TTY ketterä käänteissään. Se on varmasti liiankin ketterä. Viimeisissä laitostason YT-neuvotteluissa irtisanottiin 2,5 professoria. Irtisanomisperustena oli työtehtävien olennainen ja pysyvä väheneminen. 0,5-irtisanomista tarkoitti, että kyseiselle professorille tarjottiin irtisanomisen jälkeen 50-prosenttista työaikaa ja palkkaa. Toiselle kokonaan irtisanotuista professoreista ilmoitettiin, että hän saa jäädä töihin, jos hän ottaa vastaan yliopistonlehtorin tehtävän. Asiallisesti oli siis kyse tämän professorin alentamisesta yliopistonlehtoriksi. Palkkauksessa tämä on noin 500 euron palkanalennus kuukaudessa. Outoa on, että yliopistonlehtorille on töitä, mutta laajemman tehtävänkuvan omaavalle professorille ei ole.

    Pyysin Professoriliiton tominnanjohtaja Jorma Virkkalaa selvittämään voidaanko esimerkiksi upseeri alentaa varuskunnan komentajan päätöksellä alempaan sotilasarvoon. Jorman vastaus oli odotettu. Alennus on mahdollinen vain oikeuden virkarikostuomion perusteella. TTY:llä ei ole tällaista rajoitetta.

    Edellä mainittuun 2,5 professorin irtisanomiseen liittyy sekin opetusta ja opiskelijoita aliarvioiva piirre, että profesoreille on opinto-oppaan mukaan opetusta koko lukuvuodelle 2014—2015, mutta irtisanomiset astuvat voimaan 13.11.2014.

    Demokratian hautajaiset

    Yliopistouudistuksen tuomia suuria muutoksia oli johtajavaltaisuuden introdusoiminen yliopistoihin kolmikantademokratian tilalle. Valta pantiin luomalle managerialistinen järjestelmä, jota johdetaan korostetusti ylhäältä käsin. Uudistusta ei toteutettu henkilöstön vastustuksen vuoksi täysin puhtaana jo johdonmukaisena kaikissa yliopistoissa. Esimerkiksi Helsingissä dekaanien valinta on johtosäännön mukaan edelleen tiedekuntaneuvostojen käsissä, vaikka rehtori vahvistaa valinnan. Tämä malli ei tiettävästi ole aiheuttanut suurempia, tai pienempiäkään, ongelmia yliopiston toiminnassa.

    Nyt saavutettu tulos on kuitenkin asetettu vaakalaudalle. Helsingin yliopiston johtosääntöä ollaan muuttamassa johtajavaltaiseen ja valtaa keskittävään suuntaan. Esityksen on tehnyt rehtorin asettama työryhmä, jossa ovat olleet kansleri, yksi oikeustieteellisen tiedekunnan professori, hallintojohtaja ja kaksi keskushallinnon palveluksessa olevaa lakimiestä. Toimeksiannon ja käsiteltyjen asioiden tärkeyteen nähden ryhmää ei voi pitää edustavana.

    Työryhmä esittää dekaanien valintaa ehdotetaan siirrettäväksi hallitukselle — rehtorin esityksestä. Samalla dekaanien toimikautta pidennettäisiin ja kelpoisuusehtoja madallettaisiin. Vastaavasti tiedekunta- ja laitosneuvostoilta vietäisiin lähes kaikki tehtävät. Myös rekrytointiin tulisi suuria muutoksia, muun muassa kutsumenettelyn edellytysten helpottaminen (pysyvien tehtävien osalta). Tämä muutos torjuttiin äänin 8—6 Helsingin yliopiston hallituksessa 13.6.2012 eli vain runsaat kaksi vuotta sitten.

    On todella valitettavaa ja älyllisesti epärehellistä, että syvällekäyviä muutoksia luonnehditaan ”teknisiksi” siitä puhumattakaan, että ehdotusten tueksi esitettäisiin rationaalisia — tai lainkaan — perusteluja. Perusongelma uudistuksen valmistelussa on jälleen kerran siinä, että nykytilanteen sen mahdollisten epäkohtien analyysi puuttuu täysin.

    Erityisesti yliopistoissa, kriittisen ajattelun miltei viimeisissä linnakkeissa, olisi erityisen tai jopa itseisarvoisen tärkeää, että merkittävistä valtaan ja liittyvistä kysymyksistä keskusteltaisiin avoimesti. Johtamiseen liittyviä muutoksia pohdittaessa olisi aina kysyttävä, kuka päättää mistäkin asiasta ja kenen esityksestä.

    Valtakysymysten sivuuttaminen on erityisen paradoksaalista siksi, että juuri johtajavaltaisuuden suuntaan vieneet hallinnolliset uudistukset ovat aiheuttaneet enemmän ongelmia kuin parantaneet perustoimintojen edellytyksiä yliopistolla. Työhyvinvoinnin taso laski yliopistouudistuksen seurauksena ja se on edelleen huolestuttavan alhaisella tasolla.

    Nyt kaavailtu uudistus keskittäisi vallan entistäkin tiiviimmin johtajille ja hallitukselle. Muutosta voi — jos se toteutuu — luonnehtia vallan kaappaukseksi. Ja samalla demokratian hautajaisiksi.
