Sananvapauden tila

Acatiimissa 5/2018 väitettiin, että ”tutkijoiden sananvapauden tilanne on hyvä” Suomessa. Väitteen tueksi esitettiin eri asiantuntijoiden näkemyksiä, jotka olivat kaikki asiasta suunnilleen samaa mieltä. Olisiko ollut keskustelun kannalta mielenkiintoisempaa ottaa mukaan myös jokin poikkeava näkemys? Yleensä kiistellystä kysymyksestä otetaan molempien osapuolten kannanotot, mutta Acatiimi näki hyväksi esittää vain yhden näkemyksen eri asiantuntijoiden suulla. Itse näen tämän Acatiimin lähestymistavan yhdeksi esimerkiksi sananvapauden huonosta tilasta: toisinajattelijat suljetaan keskustelun ulkopuolelle.

Uskoisin, että sananvapauden tila tutkijoiden kannalta riippuu paljolti käsiteltävästä aiheesta. Perhetutkimus näyttäisi olevan yksi alue, jossa tutkijat kohtaavat sananvapauden rajoituksia, erityisesti, jos he saavat tutkimustuloksia, joiden mukaan lapsi voi parhaiten biologisen isänsä ja äitinsä eheässä avioliitossa tai jos he filosofisesti puolustavat lapsen identiteettioikeuksia: oikeutta tuntea biologinen isänsä ja äitinsä ja kasvaa heidän hoidossaan.

Viimeaikainen kohu pedofiliaa käsittelevästä kirjoituksestani on tosin herättänyt itselleni kysymyksen, onko myös seksuaalisten suojaikärajojen puolustamisesta tulossa tabuaihe, johon ei saa koskea. Toinen mahdollisuus on, että kohu johtuu edellä mainitsemastani tosiasiasta, että lapsen oikeutta isään ja äitiin ei tutkijoiden maailmassa ole enää poliittisesti korrektia puolustaa. Jos sananvapautta ei rajoitakaan se, että yliopisto irtisanoutuu tietystä näkemyksestä, niin mitä tekee sananvapaudelle, jos yliopisto uhkaa näkemyksen esittämisestä kurinpitotoimenpiteillä?

Jos tutkija ei ole itse kohdannut pyrkimyksiä rajoittaa sananvapauttaan siitä yksinkertaisesta syystä, ettei hän ole koskettanut kiellettyjä aiheita vääristä lähtökohdista, hänelle voi syntyä illuusio sananvapaudesta. Siksi tällaisessa keskustelussa olisi tärkeää kuulla kiistan molempia osapuolia.

Tiedettä ja mielipiteitä

Suomalaisen Tiedeakatemian esimies Risto Nieminen ja pääsihteeri Pekka Aula pohtivat Acatiimissa 5/2018 tutkijoiden sanavapautta. Asiaa koskeva keskustelu liittyy siihen, että jotkut yliopistojen ja opiskelijajärjestöjen edustajat ovat pitäneet professori Tapio Puolimatkan kirjoittelua ja esiintymistä moitittavana.

Niemisen ja Aulan kommentit herättävät jatkokysymyksiä. Niemisen ja Aulan mukaan ”on tutkijan ammattitaitoa, ettei tiedettä käytetä oman uskonnollisen tai poliittisen agendan edistämiseen”.

Niinpä. Ihmettelen kuitenkin, miksi tämä hyvä ja tärkeä sääntö nostetaan esiin juuri Puolimatkan kohdalla, vaikka lukemattomat muut tutkijat, professorit ja opettajat saavat vapaasti titteliinsä ja arvovaltaansa nojaten esittää julkisesti poliittisia ja moraalisia kannanottoja.

Ulkopuolinen ei voi välttyä vaikutelmalta, että kaikki mielipiteet ovat sallittuja, mutta toiset ovat vielä sallitumpia kuin toiset.

Kuuntelin vast’ikään Helsingin tiedekampuksella kiinnostavaa luentoa, jonka aikana professori — itse asian ohessa — moitti värikkäin sanakääntein muun muassa Yhdysvaltain politiikkaa, kapitalistista järjestelmää ja markkinataloutta sekä miesvaltaista yhteiskuntaa. Tämä ei ollut mikään poikkeustapaus; useat tutkijat ovat sitoutuneet esimerkiksi feministiseen agendaan, ja antavat sen näkyä ja kuulua myös opetus- ja tutkimusmenetelmiä tai -aiheita valitessaan Joillakin aloilla taas jo opintoihin kuuluu jaksoja, joiden perustaa on vaikea pitää tiukan tieteellisenä: erilaisia tempauksia, mielenosoituksiin osallistumista, taideprojekteja jne.

Minun puolestani yliopistolaiset voivat vapaasti julistaa feminismiään, viljellä tasa-arvokäsityksiään, vaatia saartoa Israelille, potkuja ulkoministerille tai kasvisdieettiä kaikille, mutta soisin saman ja yhtä näkyvän sanan- ja mielipiteenvapauden myös konservatiivisille näkemyksille, kuten sellaisille, joita Puolimatka edustaa. Jos yliopistomaailmasta kuuluu vain yhdenlainen ääni siksi, että muut vaiennetaan poliittisesti epäkorrekteina, murenee koko instituution uskottavuus, kuten Yhdysvalloissa on jo käynyt.

Vastaavan mielipidevinouman voi havaita Suomessakin. Aiemmin siitä uskalsivat huomautella vain ne harvat poliitikot, jotka eivät pelkää populistileimaa tai akateemisten piirien ylenkatsetta. Nyt sen onneksi nostavat esiin muutkin, viimeksi keskustan kansanedustaja Sirkka-Liisa Anttila tiedotteessaan ja tuoreessa ulostulossaan.

Tosiasioista ei voi johtaa arvoja eli siitä, miten asiat ovat, ei voi päätellä, miten niitten tulisi olla. Humen giljotiini on vain yksi syy siihen, miksi kirjoittamisen ja puhumisen vapaus pitäisi sallia yliopistossa joko kaikille tai ei kellekään. Oikeiden ja väärien mielipiteitten valikointi johtaa silkkaan mielivaltaan, eikä ole kenenkään etu, jos yliopisto alkaa näyttää punaviherliberaalien propagandakoneistolta.

Vapaus ja sananvastuu

Yliopiston rehtori ilmoitti viime kesänä, ettei professorin julkaisema kirjoitus edustanut yliopiston arvoja tai linjaa ja seurauksena ”ryhdymme konkreettisiin toimenpiteisiin”. Acatiimi-lehdessä 5/2018 suomalaisen tiedeakatemian esimies ja sihteeri kertovat, että kyse oli aivan muusta kuin akateemisesta vapaudesta ja sen rajoittamisesta. Työnantajalla on näet oikeus irtisanoutua tutkijan mielipiteistä, jos jutun alla mainitaan tutkijan työpaikka. Acatiimi vertaa Suomen hyvää sananvapaustilannetta Unkariin, mistä sen sijaan kuului huolestuttavia uutisia. Siellä hallitus aikoo lakkauttaa 13 opiskelijan akateemisen koulutuslinjan, todellisena syynä se, että sananvapaus on autoritaariselle hallinnolle aina yhtä hankala asia.

Mahtaako lehti nyt hyssytellä kotimaisia ongelmia samalla kun ulkomaan asioita suurennellaan? Kyse on kai myös siitä, kuinka vauhdikkaiden mielipiteiden kanssa ollaan liikkeellä. Professori ei ollut kieltämässä holokaustia, vaan pohdiskeli mahdollisen asennemuutoksen alkamista pedofiliaan suhtautumisessa.

YLE julkaisi syyskuussa kirjailija Leena Krohnin haastattelun, jossa hän lausui: ”Sananvapautta rajoitetaan myös poliittisen korrektiuden ja liberaaliuden nimissä. Tilanne on minusta pahempi kuin 1970-luvulla, jolloin sananvapautta myös laajasti rajoitettiin.” Siinäkin voi olla näkemys, jota professori ei enää uskaltaisi allekirjoittaa ilman työnantajan lupaa.

‘Refugee roulette’ in granting the right to study in Higher Education programs in Finland

In the study on the Self and Practical Wisdom, the philosopher P. Ricoeur contemplates on what spheres of public domain the notion of justice remains valid. In his view, if we want justice to truly mean fairness, we should find ways to allow practical wisdom pass through the whole hierarchy of institutional mediations (Ricoeur, 1992). Nowadays, this includes immigration services and public education. For this kind of practical wisdom, some thinking would be necessary on both the diversity of individual and collective contributions, and how these are distributed.

In the case of refugees, it seems that the political system, as represented by governmental policies, regulates the value of contributions on the basis of devaluation of the refugee status. Refugee is a displaced person who has been forced to cross national boundaries and cannot return home safely. To be granted refugee status, a displaced person goes through a Refugee Status Determination Process (RSD) run by the government of the host country and based on international law. However, as there is no specific method mandated for RSD apart from the commitment to the 1951 Refugee Convention, countries may interpret elements of the Convention in different ways. The term 'refugee roulette’ articulates the phenomenon of using arbitrary ways to deal with refugee status determinations. The term was used in a study (Ramji-Nogales, Schoenholtz & Schrag 2007) investigating asylum determination outcomes in the US and Canada. The findings of the study indicate that decisions are largely dependent upon the adjudicator assigned to an application. Resulting disparities in rates of granting asylum are therefore problematic. Rather than based on specific criteria, it is a matter of conviction who is granted a refugee status and who is not.

In this opinion letter, we argue that in Higher Education in Finland, the phenomenon of refugee roulette manifests even after the refugee status has been granted to asylum seekers nowadays.

In 2015, Finland accepted more than 30.000 asylum requests from mainly Afghanistan, Iraq and Somalia, following increasing refugee flows in Europe. During that period, the anti-immigration populist party’s rise in the coalition government ushered a move away from pro-immigration policy. One dimension of tightened policies includes the re-evaluation of security status of countries of origin. For example, although the Islamic State maintains a firm grip, the Finnish Immigration Service (Migri) declares these destinations as safe and proceed with asylum seekers’ deportations.

Critical questions that arise concern both who get deported and who stay back. In this letter we focus on the latter. Migri claims that decisions do not affect those granted permits for humanitarian protection. They do, however, prevent extensions on similar grounds. Residence permits can be issued for work, study or family ties, while other grounds for asylum are assessed on an individual basis for each applicant.

Contrary to statements of good intentions, existing policies and practices eventually deprive refugees from the status.

University policy is one example of such deprivation. As a result of migration flows, immigrants and refugees with a background in Higher Education arrived in Finland. Consistent with the credo of equality and justice of the Finnish educational system, the Ministry of Culture and Education funds a set of programs aiming to welcome and support those with immigrant and refugee background. In this way, the refugees’ pathway to placement and to opportunity is supposed to open up. The SIMHE project is one such initiative that aims for guidance and counselling following a diagnostic process where particularities of individual cases are noted and brought forward for consult. The project is run by 6 Universities and Universities of Applied Sciences across the country.

One measurement to facilitate the process of equivalence of qualifications is by mapping competences. In order to be eligible to participate in program activities, refugees need to have a residence permit. Current immigration strategy, however, invalidates the refugee status and, as a result, the refugees’ right to, for example, apply for SIMHE scholarship is cancelled. One example of such cancellation is the rejection of an application for Helsinki Summer School. As the refugee status has changed due to marital status to a Finn, the applicant is no longer considered eligible for the scholarship, although the decision for the new situation is pending. In this case, getting married seems to be penalized by policies and practices.

And yet, has the state truly acknowledged displaced persons as being genuine refugees? The way things happen in Finland, an identity card is issued to certify that the displaced applicant was admitted to a reception center upon arrival. The card is the token that the applicants need asylum and that their application to gain a right to stay in the country has been recognized. In relation to the status granted on the basis of the 1951 Convention and its amendments (e.g. the 1967 Protocol and others), this is a complementary form of protection.

There is a twofold legal gap here that relates to residence permits. In reality, they do not guarantee refugee protection. First, while residence permits were issued for humanitarian protection during the years 2015 and 2016, this is no longer the case. Second, changes in the law allow only those working, studying or have family ties in the country to apply for permit. As a result, highly educated refugees are pushed to the labor force. According to a study (Maury 2017), this means getting trapped in low paid service sector jobs, in an effort to both make a living and pay tuition fees. Being stripped of the status, highly educated refugees are no longer eligible to free Higher Education. As a repercussion, even when having a chance to study, students with an immigrant background are pushed to choose occupations that are beyond the sphere of own interests and educational background (Masoud 2018).

Instead, it seems that current policies push highly educated refugees into a vicious loop where they endlessly move from dealing with bureaucracy for uncertain purposes, to finding ways to cover language requirements, to coming to terms with the fact that they need to be re-educated, and end up with making choices that alienate from their core decisions.

In the end, the loop perpetuates when immigration policies serve anti-immigration purposes. Unfortunately, university policies second such practices. As it happens with those deported, the ones who stay are not recognized as genuine refugees, as permits actually create the basis for differential treatment that, at the end of the road, will devalue them as scholars, students and professionals. Such university policies play roulette with refugees just as adjudicators have done elsewhere. They do so by introducing a kind of split reference, by welcoming only on the surface, while they end up rejecting.

Returning to the right to contribute to society, the system currently regulates the value of refugees’ contributions on the basis of the devaluation of the status. It does so both by violating the definitions of the 1951 Convention and by raising a cloud of confusion that actually masks discrimination and suspicion with unclear Higher Education policies that in practice become the basis of unfair decisions and actions.
